Terms and Conditions of Membership
MEMBER AGREEMENT
- The decision to enter into this agreement remains at the sole discretion of Chorley Leisure, who reserve the right to verify or require proof of all information provided by the member. Should the member provide any fraudulent or wrongful information, Chorley Leisure reserve the right to terminate this agreement.
- Memberships commence upon the receipt of start-up fees and any required pro rata and on the date of this agreement. This agreement shall be considered legally binding between Chorley Leisure and the member.
- Marketing & Data Protection: The provision of the member's details implies the acceptance of the terms and conditions of the Data Protection Act. All data is held in accordance with our GDPR policy. The member agrees for their details to be used for marketing purposes during and beyond the end of the agreement, members can opt out at any time.
- Members will be required to complete a Health Commitment Statement to warrant that they are in good health and know of no reason why they should not safely participate in exercise.
- Money Back Guarantee: A 10-day money back guarantee from the date of membership commencement is offered to all new members, providing the centres have not been used within these 10 days. All monies paid in respect to activity packages will be refunded in full should you, for whatever reason, wish to terminate this agreement within 10 days of becoming a member. A money back guarantee must be requested in writing.
- Fees & Charges: Start up fees and pro rata are payable at the point of sign up and cover our reasonable administration costs. A pro-rata payment is the amount required to cover the period from the day of becoming a member to the date of the first Direct Debit collection. If you fail to pay any monies within your agreement or if any Direct Debit is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay us on demand an administration fee of £15.
- In order to qualify for certain membership packages, you are required to provide evidence of eligibility. Should this evidence not be presented within 7 days of sign up, you will be required to pay the standard monthly non-concessional rate.
FREEZING YOUR MEMBERSHIP
- We offer the opportunity to temporarily freeze your membership if paying by direct debit in the event of prolonged absence such as an serious illness or injury. This benefit is available for a minimum of one month and a maximum of three months at a time and carries a reduced fee of £5.00 per person per month.
- If you need to freeze your membership for medical reasons, this is available free of charge upon receipt of suitable written evidence (doctors note, appointment of surgery letter etc).
- All requests to freeze must be received in writing to be processed before the 21st of the month to avoid your next Direct Debit being processed. At the end of the freeze period, your monthly Direct Debit will revert to your original fee.
- Please note, this facility is not available on annual subscriptions, unless due to medical reasons where, upon receipt of suitable written evidence, your membership end date will be extended for up to a maximum of 3 months.
- This facility is offered at the discretion of Chorley Leisure.
REFUNDS & TRANSFERS
- Membership fees are non-refundable and non-transferable. At the discretion of Chorley Leisure, annual refunds on the basis of medical reasons or relocation outside of 8 miles of a CBC Leisure Centre will be considered, on the provision of suitable written evidence (doctors note, proof of new address etc).
PRICING
- Prices may be reviewed during the course of any 12-month period, we undertake to provide at least 30 days written notice of any price change.
TERMINATION
(1) BY THE MEMBER
- Upon completion of the minimum contract term of your membership, you may request to cancel your membership.
- If you wish to cancel your membership, please notify us in writing no later than the 15th of the month in order for your membership to be cancelled at the end of the current month
- Cancellations that are sent later than the 15th will be processed to end on the last day of the following month, for which payment will be taken.
- Please do not cancel your Direct Debit, as this may create an outstanding charge on your account.
- Cancellation requests are required in writing via email and we recommend you keep a copy for your records. We are unable to take cancellation requests over the phone or in person verbally.
- We reserve the right to collect any monies outstanding in the event of this agreement not being upheld.
(2) BY CHORLEY COUNCIL
- Chorley Leisure reserves the right to terminate any membership agreement if the member's conduct is considered to be injurious to the character, name or interest of the organisation or other members
- The agreement may also be terminated if there is any breach of regulation or condition that may exist from time to time, or should fees remain unpaid 30 days after the due date
- In the event of termination, the member will not be entitled to a refund
CONSUMER RIGHTS
- The terms of this agreement do not infringe upon any other legality applicable to the member under the terms of any consumer legislation or the Direct Debit Guarantee.
LAW
- Relevant UK law shall apply to this contract and the relevant courts of the UK shall have exclusive jurisdiction to deal with any disputes arising in relation to it.
